Multi-day and residential photography tours - terms and conditions

1. ENTIRE AGREEMENT:

This agreement constitutes the complete understanding between Ian Worth Photography and the client, superseding all prior agreements. Modifications can only be made in writing and require signatures from all relevant parties.

2. RESERVATION:

Upon payment, Ian Worth Photography reserves the agreed time and date, refraining from other reservations. The 3-day tour deposit of £300 is non-refundable, even in case of date changes or workshop cancellations (e.g., acts of God, fire, strike, or extreme weather). Acceptance of a booking is confirmed via email, with an agreement sent for signing. 

The receipt of a booking fee does not imply acceptance of a booking. Ian Worth Photography will confirm the acceptance of your booking by email, and send out an agreement for you to sign. When the agreement is signed and returned, your booking will be confirmed. 

The full amount is due 6 weeks before the workshop date. Check the website for fees.

3. CANCELLATION:

In the unfortunate event that the client needs to cancel the contracted services for the photography workshop, the following terms shall apply:

Cancellations up to 30 days before the Workshop Date:

  • If the client decides to cancel the workshop before 30 days of the scheduled date, Ian Worth Photography will issue a refund for the amount paid by the client, less the deposit of £300. 

Cancellation Within 30 Days of the Workshop Date:

  • Cancellations made within 30 days of the workshop date will incur a 50% cancellation charge. In such cases, Ian Worth Photography will only refund up to 50% of the full workshop amount paid by the client.

(For example, if the full tour fee was £1000 and the client cancels the booking within 30 days before the tour date, only £500 would be refundable. )

Underbooking

Underbooking is the situation in which the minimum number of bookings required to run a tour is not met, and if we have to cancel a tour for this reason, we will not do so less than 30 days prior to the scheduled date. In this situation, a full refund will be given.


4. UNFORESEEN CIRCUMSTANCES:

In the event of Ian Worth Photography being unable to attend due to unforeseen circumstances, an alternative date will be offered, or full reimbursement will be provided. Liability is limited to the return of all received payments.

5. REFUNDS AND AMOUNTS:

All refunds and amounts are at Ian Worth Photography's discretion. Cancellations must be in writing.

6. WEATHER AND ADVERSE CONDITIONS:

No refunds for adverse weather or conditions caused by nature or unforeseeable human behaviour. Ian Worth Photography may attempt to reschedule, but it is not guaranteed.

7. TRAVEL:

Workshops exclude travel to the location. Participants are responsible for transportation. Details on travel inclusion are specified in the workshop description.

8. WORKSHOP DURATION:

Refer to the website itinerary for exact details.

9. ACCIDENT, DAMAGE AND LOSS:

Clients must ensure adequate insurance for themselves, their belongings, and equipment against injury, accident, damage, loss, and theft. Ian Worth Photography is not liable for client or equipment loss or damage during workshops.

Ian Worth Photography cannot accept any liability for loss or damage sustained by the client or their equipment. Clients participate in workshops and one-to-one sessions at their own risk. It is the sole responsibility of each client to ensure their own safety and satisfaction at each location chosen for the workshop. Clients acknowledge that they undertake these activities at their own risk, and Ian Worth Photography cannot be held accountable or liable for any incidents or outcomes before, during, or after scheduled workshops or one-to-one sessions.

Clients are expected to assess the suitability of each location and ensure their well-being. Ian Worth Photography does not assume responsibility for the client's choices in selecting workshop locations. Clients agree that their participation in workshops or one-to-one sessions implies acceptance of personal responsibility and acknowledgement of the inherent risks associated with outdoor activities and photography.

Ian Worth Photography requests that clients verify and ensure that their fitness levels meet the requirements of their chosen workshop or one-to-one session. Clients should be adequately prepared physically to engage in the planned activities, and it is their responsibility to inform Ian Worth Photography of any health concerns or limitations that might affect their participation.

10. MODEL RELEASE:

Clients grant Ian Worth Photography the right to use and publish photographs for various purposes. Clients release Ian Worth Photography from all related claims and liability.

11. METHOD OF REMUNERATION:

Payment options include the website or balance transfer via Internet banking.

12. PERFORMANCE:

Contract performance is contingent on various factors, including acts of God, government regulations, strikes, and conditions beyond control.

13. SEVERABILITY:

If any provision is deemed invalid, the overall agreement's validity remains unaffected. Invalid provisions will be replaced through negotiation.

14. AMENDMENTS:

This contract can only be amended in writing, attached, dated, and signed by both parties at the time of acceptance.

15. ACCEPTANCE OF TERMS & CONDITIONS:

By making a booking, clients agree to all terms. The person making the booking represents all included individuals, binding them to the conditions.
